- Introduction
These terms and conditions apply to purchases made via the Brushandboot website. Brushandboot supplies footwear care accessories—including shoe trees, brushes, shoehorns, and shoe bags—to customers in the UK and eligible regions of Europe.
By placing an order, you agree to these terms and conditions. Please read them carefully before completing your purchase.
Nothing in these terms and conditions excludes, restricts, or diminishes any statutory rights that cannot be excluded or restricted under the laws applicable to your purchase.
- Products and Product Information
We strive to provide clear and accurate descriptions of the products sold on our website, including relevant features, specifications, prices, and images.
Customers should carefully review the information on the relevant product page before placing an order. Product colors and visual details may vary slightly depending on display settings and viewing conditions.
In the event of stock unavailability or significant errors in product information, we will take appropriate measures to resolve the issue and contact affected customers if necessary.
- Orders and Contract Formation
When placing an order, you must provide accurate and complete information, including contact details, billing information, and the delivery address.
After submitting an order, we may send an email acknowledging receipt. This acknowledgment indicates only that we have received the order and does not necessarily constitute final acceptance of the order.
A contract of sale is formed when we accept your order (usually by sending an order confirmation notice). If we are unable to accept the order, we will notify you and arrange for a refund of any payments collected (where applicable).
We reserve the right to refuse or cancel orders for valid reasons, including but not limited to: obvious pricing errors, product unavailability, suspected fraudulent activity, or an inability to verify key order information. Any order cancellations and refunds will be handled in accordance with applicable law.
4. Price and Payment
During the purchasing process, prior to order submission, the system will display the product prices and applicable shipping costs.
Before payment is finalized, the system will show the total amount due, including applicable taxes and relevant shipping fees.
You must complete payment using the available payment methods displayed on the checkout page. Orders will be processed upon confirmation of payment receipt.
Brushandboot uses Stripe as its payment processing service provider. Payment information is handled in accordance with relevant payment processing regulations and our Privacy Policy.
We do not offer recurring subscription billing for purchases governed by these Terms and Conditions; each accepted order applies solely to the items purchased in that specific transaction.
- Delivery and Shipping
5.1 Delivery Destinations
Brushandboot serves the UK and eligible European destinations. Available delivery destinations and shipping options will be displayed at checkout.
Orders will be prepared for shipment once payment is confirmed and relevant order processing reviews are complete.
5.2 Delivery Carriers
We partner with reputable delivery carriers (including DHL, FedEx, and UPS Priority services), depending on the destination and available services.
The specific carrier and delivery service used for an order may vary based on the destination, package requirements, and existing arrangements.
5.3 Estimated Delivery Time
For shipments to UK destinations, the estimated transit time is typically 5 to 12 business days after dispatch, depending on the delivery service and destination shown at checkout.
For other European destinations, applicable estimated delivery times will be specified in the delivery information at checkout or in our shipping policy.
Estimated transit times are calculated in business days and generally exclude weekends and public holidays. Actual delivery times may be affected by carrier operations, customs procedures (where applicable), weather conditions, public holidays, or other events impacting transport.
If a specific delivery date has been agreed upon, that agreement remains valid subject to applicable laws.
5.4 Tracking Notifications
We will use the email address provided at checkout to send updates regarding your order and delivery status. Depending on the carrier and available information, we may send notifications at key stages, such as shipment dispatch, the package’s arrival at a carrier facility, and the local delivery phase.
We also provide tracking details so customers can monitor the shipment progress of their packages at any time. Customers should verify that their email address is correct and check both their inbox and spam folder for order-related emails.
5.5 Delivery Delays or Non-Delivery
If your order does not arrive within the estimated delivery timeframe, please contact us by emailing Email: auditor@brushandboot.com and providing your order number.
We will verify the order details and, if necessary, initiate an inquiry with the relevant carrier. Once the inquiry is complete and the specific circumstances have been assessed, we will arrange an appropriate resolution, which may include reshipment or a full refund.
Any resolution will be handled in accordance with the applicable contract, the specific facts of the case, and relevant laws and regulations.
5.6 Loss or Damage in Transit
Where delivery is arranged by Brushandboot, and unless otherwise provided by applicable law, the risk of loss or damage to the goods remains with Brushandboot until you (or a person designated by you, other than the carrier) take physical possession of the goods.
The transfer of ownership of the goods is governed by the applicable contract and legal provisions. Nothing in these terms and conditions shall result in the transfer of the risk of transport to the consumer simply because the goods have been handed over to the carrier.
If a package is suspected to be lost or arrives damaged, please contact us as soon as possible so that we can investigate the situation and assist in resolving the issue. This requirement does not limit any rights you may have under the law.
- Right of Withdrawal
6.1 Fourteen-Day Withdrawal Period
For eligible online purchases, consumers generally have the statutory right to withdraw from the purchase without giving any reason within 14 days of receiving the goods.
If an order is delivered in installments or consists of multiple items delivered separately, the applicable withdrawal period will be calculated in accordance with relevant legal provisions.
To exercise this right, please send an email to Email: auditor@brushandboot.com clearly stating your intention to withdraw from the purchase. Please include your order number and details of the relevant products in the email.
You may use the standard withdrawal form provided below, although doing so is not mandatory.
6.2 Returns
After notifying us of your decision to cancel your order (exercising your right of withdrawal), you must return or hand over the goods to us without undue delay (and in any event within 14 days of the day on which you communicated your decision to us), in accordance with applicable rules.
Please contact us before returning the goods so that we can provide the relevant return instructions and address.
Unless otherwise agreed or required by applicable law, customers exercising their standard right of withdrawal must bear the direct costs of returning the goods (provided we have disclosed this obligation in accordance with the law).
You may handle the goods to the extent necessary to establish their nature, characteristics, and functioning, just as you would be able to do in a store. If handling goes beyond what is necessary and results in a decrease in the value of the goods, the law may allow for a deduction of the corresponding amount.
6.3 Refunds after order cancellation
In the event of a valid exercise of the right of withdrawal, we will refund the amounts required by law, including applicable standard delivery costs.
If you chose a more expensive delivery method—and the law permits such a distinction—we are not required to reimburse the additional cost exceeding our lowest standard delivery fee.
Refunds will be processed without undue delay and within the applicable statutory timeframes. We may withhold the refund until we have received the returned goods or until you have provided proof that you have sent the goods back, whichever occurs first.
Refunds will generally be made using the original payment method, unless we have agreed otherwise with you and such an arrangement complies with the law.
6.4 Exceptions
The statutory right of withdrawal does not apply to all types of purchases. Any exceptions are subject to applicable law and relate to specific goods or transactions.
Nothing in this section affects your rights as a consumer regarding goods that are defective, damaged, not as described, or otherwise do not conform to the contract.
- Damaged, defective, or incorrect goods
If the goods arrive damaged, defective, or significantly different from the ordered products, please email Email: auditor@brushandboot.com
To help us assess the situation, please provide:
Your order number. The name of the affected product(s). A brief description of the issue.
Clear photos showing the damage, malfunction, or incorrect item (if applicable).
7.1 Assessment and Handling
We will review the information provided and determine the appropriate next steps in accordance with applicable law.
Where appropriate, Brushandboot may arrange a refund or replacement based on photos and order information, without requiring the return of the affected items. We will notify you if further information or alternative arrangements are required.
Where applicable law stipulates that return costs must be borne by the seller, the customer will not be required to pay return costs for defective or incorrectly delivered items.
7.2 Statutory Remedies
If goods do not conform to the contract, consumers retain their rights to remedies under applicable law. Depending on the circumstances, these remedies may include repair, replacement, price reduction, or contract rescission and a refund.
The available remedies and the conditions for exercising them depend on applicable legal provisions and the specific circumstances of the purchase.
Our review process does not limit any mandatory rights consumers enjoy under UK law or applicable European law.
- Refund Processing
Once a refund is approved, we will initiate the refund process within the timeframes required by law (i.e., applicable statutory deadlines or timeframes previously communicated to you).
The time required for the refund amount to be credited to your account may depend on the payment method and the relevant financial institution.
For returns resulting from a change of mind, refunds will be processed in accordance with Section 6. For damaged, defective, missing, or incorrectly delivered items, the handling process will depend on applicable legal remedies and the specific circumstances of the order.
- Customer Responsibilities
Customers are responsible for providing accurate order details and using products in accordance with their intended normal use and any accompanying instructions.
Customers should contact us promptly if any issues with the order arise. We may request necessary information to identify the transaction, assess the reported issue, or process the return.
Nothing in this section constitutes an unlawful restriction of consumers’ statutory rights.
- Intellectual Property
Content published on the Brushandboot website (including original text, photographs, page layouts, and other materials owned or lawfully used by Brushandboot) may be protected by applicable intellectual property laws. Unless permitted by law or authorized by the relevant rights holder, the content of this website may not be reproduced, republished, or reposted for commercial purposes without authorization.
These terms do not affect any rights customers may have under applicable law.
- Limitation of Liability
Nothing in these terms and conditions excludes or limits liability that cannot be excluded or limited by law.
Subject to the above limitations, Brushandboot shall be liable, in accordance with applicable law, for losses resulting from a breach of contract or other legally recognized liability, provided such losses are a reasonably foreseeable consequence.
We shall not be liable for losses that are not reasonably foreseeable or for losses arising from circumstances for which we are not legally liable.
Nothing in these terms limits the statutory rights or remedies available to consumers regarding defective goods, misleading product information, or other matters for which liability cannot be excluded by law.
- Events Beyond Reasonable Control
In the event of circumstances beyond our reasonable control affecting order processing or delivery, we will take reasonable steps to assess the situation and inform affected customers.
Such events may include severe weather, traffic disruptions, public emergencies, or carrier service interruptions.
These terms do not deprive consumers of their rights to cancel orders, obtain refunds, or seek other remedies under mandatory laws.
- Complaints and Dispute Resolution
If you have any questions or concerns regarding your order, products, delivery, or refunds, please contact us first so that we may investigate the matter.
Email: auditor@brushandboot.com
We will review complaints based on order records, information provided, and applicable contractual and legal requirements.
If a dispute cannot be resolved directly, either party may seek redress through a competent court or utilize other applicable dispute resolution procedures.
Nothing in these terms and conditions prevents consumers from contacting relevant consumer protection agencies or exercising any statutory rights.
- Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws applicable to the relevant transaction, subject to mandatory consumer protection regulations.
If English law applies, disputes shall be resolved by the competent courts of England and Wales; however, this is subject to any mandatory jurisdictional rules that grant consumers the right to bring proceedings in other competent courts.
For consumers residing in other European countries, any mandatory protections afforded by the law governing the contract remain unaffected.
Nothing in this section deprives consumers of statutory rights that cannot be excluded by agreement.
- Changes to Terms
We may update these Terms and Conditions to reflect changes in our products, business practices, or applicable legal requirements.
The version published at the time an order is placed generally applies to that purchase, unless changes are required by law or otherwise validly agreed upon by both parties.
Any changes will be posted on this page, with the updated revision date indicated where applicable.
